Buckrr Software Licence Agreement

Subject to the terms of this agreement and to payment of the applicable fee, Licensor grants you a limited, non-exclusive, non-transferable, revocable licence to:

• Install and use the Software on devices you own or control, up to the number of devices included in your plan
• Use the Software for personal or internal business purposes

This licence governs any update to the Software that replaces, repairs, or supplements it, unless that update is supplied with a separate licence.

You may NOT:

1. a)Copy, redistribute, publish, sell, lease, sublicense, or otherwise transfer the Software or any portion thereof to any third party, in any form (source code, compiled executable, or otherwise) whether for free or for commercial purposes;
2. b)Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software;
3. c)Sublicense, rent, lease, lend, or transfer the Software or any rights therein to any third party;
4. d)Use the Software to develop competing products or services;
5. e)Remove, alter, or obscure any proprietary notices, labels, or marks on the Software;
6. f)Use the Software in any manner that violates applicable laws or regulations.

Restriction (b) does not apply where, and only to the extent that, applicable law grants you a right that cannot be excluded by contract. In the European Union this includes the right to decompile the Software so far as necessary to achieve interoperability with independently created software, under Article 6 of Directive 2009/24/EC.

The Software, including but not limited to its source code, object code, documentation, design, structure, and organisation, is the exclusive property of the Licensor and is protected by copyright laws and international treaty provisions. The Licensor retains all intellectual property rights in and to the Software, including but not limited to copyrights, trademarks, trade secrets, and patents.

This licence does not grant you any rights to trademarks or service marks of Licensor.

4.1 Security updates. Licensor supplies security updates for each major version of the Software until the end of its support period, which is five years from the release of that major version. The end date is shown before you buy, on the checkout page and in the Software (Help > About and License > Manage License). For the current major version it is September 2031.

4.2 All updates on a Perpetual licence. If you hold a Perpetual licence, every update, upgrade and new version of the Software that Licensor releases until the end of September 2031 is included in the price you paid, with no further charge.

4.3 Yearly licence. While your Yearly licence is active, every update, upgrade and new version of the Software that Licensor releases is included in your subscription.

4.4 After those dates. A Perpetual licence does not end when the periods in 4.1 and 4.2 end: you may keep using the versions of the Software you received. After those dates Licensor may still supply updates, upgrades and new versions, at its discretion.

4.5 Technical assistance. Licensor answers questions about the Software sent to support@buckrr.com, at its discretion and without a guaranteed response time.

4.6 Your statutory rights. Nothing in this section limits the updates a consumer is entitled to by law to keep the Software in conformity with this agreement.

Because the Software is distributed directly by the Licensor and not through any app store or marketplace, no store or marketplace operator has any obligation to furnish maintenance or support for it.

All file comparison, copying, and moving operations are performed locally on your device. The Software does not upload, transmit, or store the contents of your files.

The Software does contact Licensor's servers for licensing purposes. When you activate the Software, it sends a machine fingerprint, which is a one-way hash derived from your computer name, the serial number of your system drive, and your processor description, together with your computer's name, which is shown in your account so you can tell your computers apart, and the version of the Software. When it later checks your licence, it sends the licence token it was given and the same fingerprint. Licensor stores that fingerprint against your licence in order to count how many devices a licence is used on, and so that a licence file copied to another computer stops working. The hash cannot be reversed to recover those details.

The Software also contacts Licensor's download server when it starts and when you choose Check for Updates, to learn whether a newer version exists. That request carries no licence token, fingerprint or file information; the server sees your IP address and the request itself. An update is downloaded and run only when you choose Install now.

What Licensor collects, why, and for how long is set out in the Privacy Notice at https://buckrr.com/privacy, which forms part of your agreement with Licensor.

YOU ARE SOLELY RESPONSIBLE FOR BACKING UP YOUR DATA BEFORE USING THE SOFTWARE.

Licensor warrants that the Software is free of spyware, trojan horses, viruses, or other malware at the time of your download, and that it works as described in the user documentation.

No warranty is provided for Software that is not executable on the device, that has been modified without authorisation, handled inappropriately or culpably, or combined or installed with inappropriate hardware or software, whether by you or by a third party, or where other reasons outside Licensor's sphere of influence affect its executability.

You should inspect the Software promptly after installing it and report any defect to support@buckrr.com without undue delay. A defect report will be investigated if it is sent within thirty (30) days of discovery. If Licensor confirms a defect, Licensor may choose to remedy it either by fixing the defect or by substitute delivery. If the Software fails to conform to this warranty, you may instead ask for your purchase price back under the 30-day money-back guarantee described in the Terms of Service.

The statutory periods of limitation apply to claims based on faults, and your statutory rights in respect of defective digital content are not affected by anything in this section.

Licensor's responsibility in the case of violation of obligations and tort is limited to intent and gross negligence. Only in the case of a breach of essential contractual duties (cardinal obligations) is Licensor also liable in the case of slight negligence. In any case, liability is limited to the foreseeable, contractually typical damages.

THE LIMITATION ABOVE DOES NOT APPLY TO INJURIES TO LIFE, LIMB, OR HEALTH, AND DOES NOT APPLY WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

Licensor takes no responsibility for damage caused by a breach of the restrictions in Section 2. To avoid data loss, you are required to keep your own backups. You are aware that if the Software is altered or manipulated, you will not have access to it.

Buckrr is sold with a 30-day money-back guarantee. Refunds, and your statutory right to withdraw from a distance purchase, are set out in full in the Terms of Service at https://buckrr.com/terms. A summary is published at https://buckrr.com/refund.

A refunded licence is revoked. It is no longer valid, and the Software cannot be activated again with it.

This licence is effective until terminated. Your rights under this licence terminate automatically, without notice, if you fail to comply with any of its terms. It also ends when your licence expires or is refunded.

Upon termination you must cease all use of the Software and remove it from your devices.

Termination does not limit any of Licensor's other rights or remedies at law or in equity.

Except as section 4 provides, Licensor may, at its discretion, provide updates, patches, or new versions of the Software. Licensor also reserves the right to modify the terms of this licence.

Licensor will give you prior notice of any material change, by email to the address associated with your licence. Changes take effect on the date stated in that notice. If you do not accept a change, you may stop using the Software; where the change materially disadvantages you, you may end this agreement and, if applicable, request a refund under the Terms of Service.

This Agreement is governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions.

Disputes are subject to the jurisdiction of the courts of Poland. If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory law of your country of residence, nor of your right to bring proceedings in the courts of that country.

If any provision of this Agreement is held to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

This agreement, together with the Terms of Service and the Privacy Notice published at https://buckrr.com, constitutes the entire agreement between you and Licensor concerning the Software, and supersedes all prior communications and proposals concerning it, whether oral or written.

No amendment to this agreement is effective unless made in accordance with Section 10 or agreed in writing by Licensor.

Nuitka compiles this application to a native standalone build. The Nuitka compiler itself is licensed under the GNU Affero General Public License v3 (AGPL-3.0) and is used solely as a build tool - it is not redistributed with the application. Portions of Nuitka's Runtime Library are linked into the compiled binary; that Runtime Library is provided under AGPL-3.0 together with the Nuitka Runtime Library Exception (version 1.0), which permits distributing the resulting proprietary executable under terms of our choice.
